The petitioner is apprehending his arrest in connection with Muffasil P.S.Case No.12 of 2018 and G.R.Case no.119 of 2018 registered for offences punishable under Sections 406, 420, 385, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he has taken altogether Rs.3,50,000/- for land which does not belong to him and now he is not returning the money.
Submission of the learned counsel for the petitioner is that he has taken only Rs.50,000/- and he is ready to pay back the same and for other payment, he is not responsible. Heard learned A.P.P. and the learned counsel for the informant.
Patna High Court Cr.Misc. No.24310 of 2018 (2) dt.03-05-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
