====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-02-2025 Heard learned Counsel for the petitioner as well as learned APP for the State.
2. In this case, the petitioner is seeking regular bail in connection with Banka P.S. Case No. 586 of 2015 registered for the offences punishable under Sections 363 and 364 of the Indian Penal Code.
3. As per prosecution case, the son of the informant went for natural call but he did not return.
4. The learned Counsel for the petitioner has submitted that the petitioner is innocent and he is not involved in any other case of similar nature. The alleged victim in his statement under Section 164 of the Cr.P.C. has named four persons including the petitioner and three of them have been
Patna High Court CR. MISC. No.86666 of 2024(2) dt.18-02-2025 2/2 granted bail. The case of the petitioner is on exactly similar footing to those who have been granted bail by the co-ordinate bench of this Court.
5. On the other hand, the learned APP for the State opposed the prayer for bail by submitting that the case of the petitioner cannot be equated with those who have been granted bail by the co-ordinate bench since the petitioner remained absconding and due to his absconding, the investigation is still pending.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail after framing of the charges on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 586 of 2015, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
