This application for anticipatory bail arises out of Jehanabad P.S. Case No. 6 of 2017, disclosing the offence under Sections 420, 379 and 34 of the Indian Penal Code. The petitioner has a criminal antecedent, as is evident from the antecedent report received from the office of the Superintendent of Police, Jehanabad. The petitioner's name has surfaced during investigation on the basis of confessional statement of co-accused. It is alleged in the FIR that unknown miscreants, pretending to be helping the informant in withdrawal of cash on ATM, exchanged her ATM card with a fake one.

Learned counsel for the petitioner has submitted that

Be that as it may, in my opinion, no case for grant of anticipatory bail is made out. This application is accordingly rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
