2. The petitioner seeks bail in connection with Fenhara/Phenhara P.S. Case No. 40 of 2023 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, unknown criminals looted the motorcycle of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of the petitioner has come during investigation. Learned counsel further submits that similarly situated coaccused persons have been granted regular bail by Co-ordinate Bench of this Court vide order dated 29.08.2023 in Cr. Misc.

Patna High Court CR. MISC. No.84318 of 2023(2) dt.10-01-2024 2/2 No. 53421 of 2023 and Cr. Misc. No. 53604 of 2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. For the reason mentioned in the order dated 29.08.2023, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Motihari/ Concerned Court, East Champaran, Motihari in connection with Fenhara/Phenhara P.S. Case No. 40 of 2023

8. The petitioner will also mark attendance in Fenhara/Phenhara Police Station, East Champaran on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
