2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 393/302/34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, three unknown miscreants made firing on the informant and his brother and snatched their motorcycle. Brother of the informant sustained fire arms injury and died during treatment.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is no other direct or indirect evidence against the petitioner to show his complicity in the occurrence. Petitioner claims clean antecedent. He is in custody since 31.3.2023.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.86195 of 2023(3) dt.21-03-2024 2/2 for bail. He submits that during investigation, witnesses have supported the prosecution case. Petitioner has got criminal antecedent of similar nature. Charge has also been framed on 14.9.2023.

6. Considering the nature and gravity of allegation and the similar criminal antecedent of the petitioner, prayer for bail of the petitioner is rejected.
