====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 12.02.2018 in connection with Khizarsarai P.S. Case No. 369 of 2017 for the offence under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioners further submits that in the instant case petitioner is in custody since 12.02.2018 but he was not put up on T.I.P. He submits that in the instant case other co-accused namely Kail Yadav @ Dilip Yadav has been granted bail by Co-ordinate Bench of this Court in Cr. Misc. No. 19399 of 2018. Considering the fact that the petitioner has no criminal antecedent and he was not put up on T.I.P. as well as the fact that similar circumstance other co-accused has been granted bail

Patna High Court Cr.Misc. No.28330 of 2018(4) dt.05-07-2018 2/2 by Co-ordinate Bench of this Court, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-7th, Gaya, in connection with Khizarsarai P.S. Case No. 369 of 2017.
