Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Rajoun P.S. Case No. 463 of 2017 for the offenses under Section 379 IPC.
Learned counsel for the petitioner submits that petitioner was taken to custody on 14.9.2017 and as such he has completed 10 months. The stolen motorcycle was recovered from abandoned main road and not from the conscious possession of the petitioner.
Considering the aforesaid the fact that the petitioner

No.28304 of 2018(3) dt.05-07-2018 2/2 has remained in jail for 10 months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Rajoun P.S.
