The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a, 26/35 of the Arms Act.

The prosecution case, as lodged by the police personnel is that on information that Anuj Gope has concealed rifle and cartridges in his house, the police conducted a raid and apprehended the co-accused while Anuj Gope (petitioner) fled away. From possession of the co-accused one country made rifle was recovered and from possession of another Supriya Kumari 15 live cartridges were recovered.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner

Patna High Court CR. MISC. No.75838 of 2019(2) dt.27-11-2019 2/2 rather arms were recovered from the house of the petitioner. He submits that charge-sheet has already been submitted, there is no allegation of tampering of the prosecution witnesses by the petitioner and petitioner is languishing in judicial custody since 08.08.2018.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in connection with Nagarnausa Police Station Case No. 80 of 2018.
