This application for grant of regular bail arises out of Chousa P.S. Case No.59 of 2022 (Sessions Trial No.184 of 2022) registered for the offence punishable under Section 307 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner and co-accused are said to have fired upon the victim.

The petitioner is in custody since 04.07.2022. Co-accused Azhar Ali @ Ajhar Ali, in whose confessional statement the name of the petitioner has come in the F.I.R., has been granted bail by a co-ordinate Bench of this Court vide order dated 02.03.2023 passed in Criminal Miscellaneous No.60470 of 2022.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, III, Madhepura, in connection with Chousa P.S. Case No. 59 of 2022 (Sessions Trial No.184 of 2022).

This is also subject to the condition that after release the petitioner shall mark his presence in Gopalpur Police Station, District- Bhagalpur on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
