Mr. Sir Pramod Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Dandari P.S. Case No. 53 of 2017, registered for the offence punishable under Sections 363 and 366/34 of the Indian Penal Code.
The allegation is regarding the petitioner having enticed the victim girl and taken her to Nepal where he is said to have solemnized marriage and thereafter, established physical relationship with the girl.
The learned counsel for the petitioner submits that first of all, the victim girl herself has disclosed her age as 18 years and secondly, though the victim girl had all the time in the world to raise alarm and get the petitioner apprehended in case, she had
Patna High Court Cr.Misc. No.25507 of 2018(4) dt.06-07-2018 2/2 been taken away forcibly, nothing was done by the victim girl, hence, the entire story is cooked up and apparently, it appears that the victim girl was a consenting party. The petitioner is having a clean antecedent and he is languishing in custody since 04.09.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Begusarai in connection with Dandari P.S. Case No. 53 of 2017. (Mohit Kumar Shah, J) ajay gupta/- U T
