1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 318(4), 316(5), 316(3) and 61(2) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that Tatpaua PACS purchased 591.200 metric ton in the Year 2024-25, hence had to supply CMR 402.016 metric ton to State Food Corporation, Kishanganj, but the PACS supplied only 290 metric ton CMR at SFC, Kishanganj, as such, the remaining paddy i.e. 211.175 mt had to be in the godown, but on physical verification, it was found that the same has been sold, as such, government money amounting to

The learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused Raghib Alam @ Raghib Aslam along with others had approached this Court seeking anticipatory bail by filing Cr. Misc. No.76678 of 2025 and the same came to be allowed by an order dated 08.12.2025 after considering the case in detail and on merits and thus, based on parity seeks anticipatory bail.

5. Learned A.P.P. also is not in a position to oppose the submissions made by the learned counsel appearing on behalf of the petitioner.

6. Considering the submissions and taking into consideration the order dated 08.12.2025 in Cr. Misc No.76678 of 2025, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Sukhani P. S. Case No.50 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
