The petitioner apprehends his arrest in Barun P.S. Case No.69 of 2018 registered under Sections 379, 420/34 of the Indian Penal Code and Section 4/40 of the Bihar Minor Mineral Concession Rules, 1972 and Section 15 of Prevention of Pollution Act.
The Mining Development Officer lodged the case that the petitioner was illegally indulged in mining of sand. On raid, many tractors were recovered from the place of occurrence. The learned counsel for the petitioner submits that petitioner is one of the drivers of the tractor. The petitioner is not named in any mining activities. The tractor was being hired for transportation of bricks.

No.26155 of 2018 (2) dt.07-05-2018 Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is owner-cum-driver of the tractor, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad(Bihar) in connection with Barun P.S.
