Petitioner is apprehending arrest in connection with Chapra Town P.S. Case No. 442 of 2017 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 60 liters of country made wine was seized kept in two motorcycles.

Learned counsel for the petitioner submits that the petitioner has already sold out his motorcycle to one Sanjai Kumar and he has no concern with the seized motorcycles. Considering the totality of facts situation, the Court is inclined to grant anticipatory bail to the petitioner, let the

Case No. 442 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner shall deposit Rs. 25,000/- cash to the court below and the amount deposited by the petitioner shall abide by final out come of the pending criminal case.
