2. The petitioner is in judicial custody in connection with Hajipur Town P.S. Case No. 23 of 2024 for the offence punishable under Section 302 of the Indian Penal Code and section 27, 25(1-b)(a) of Arms Act lodged on 11.01.2024 by the informant, Shri Prakash.
3. As per the prosecution story, the informant alleged that in the evening of 10.01.2024, when his younger brother, Ram Prakash @ Tuntun was moving on a motorcycle, unknown miscreants stopped him and straight away shot at in his head, he died instantly. Thereafter, the Police sent the dead body for post mortem. This followed the rituals whereafter, the FIR.
4. Learned counsel for the petitioner submits that his name has come in the confessional statement of Rishu Kumar and in that background, he is in custody since 12.04.2024. The trial is at the preliminary stage and if granted relief, he shall be diligently appearing in trial without fail and undertakes not to indulge in any

5. Last submission is that similar situate Chandan Kumar Singh, Prince Kumar and Ranjeet Thakur have been extended relief in Cr. Misc. No. 61152 of 2025, Cr. Misc. No. 50212 of 2025 and Cr. Misc. No. 44464 of 2025 respectively.
6. Learned APP, Mr Bharat Bhushan opposes the prayer submitting that he has criminal antecedent and Rishu Kumar has named him.

Considering the submissions of the parties as also the development that has taken place which include the relief to some of the petitioners, an undertaking has been given as recorded above, he is in custody since 12.04.2024, in that background, this Court is inclined to extend him the privilege of bail with conditions.
8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 23 of 2024 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Driving License/Voter ID/Pan Card etc.) to show his bona fide;
Patna High Court CR. MISC. No.88167 of 2025(3) dt.13-02-2026 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance and at the end of the period a certificate be submitted before the Trial Court failing which the State shall be at liberty to take steps for cancellation of bail bonds;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
