The petitioner is languishing in custody since 12.07.2019 in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

The prosecution case is to the effect that four accused persons came on a Scorpio vehicle to the shop of the informant and robbed of cash amount, a mobile phone and other articles, leading to registration of FIR against unknown. The name of the petitioner sprang up on the basis of confessional statement of co-accused, Mantu Kumar. It is submitted by learned counsel for the petitioner that neither there is any recovery from the possession of the petitioner nor the petitioner has been put on Test Identification

Patna High Court CR. MISC. No.74683 of 2019(2) dt.04-12-2019 2/2 Parade. A statement has been made in paragraph no. 3 of the petition that the petitioner is accused in seven other cases, apart from the present case and in most of the cases, he has been granted bail.

Learned APP for the State submits that the petitioner is having criminal antecedent and his name surfaced on the basis of confessional statement of co-accused, Mantu Kumar. Considering the fact that there is neither any recovery from the possession of the petitioner nor the petitioner has been put on Test Identification Parade and the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Vaishali at Hajipur, in connection with Goraul P.S.
