The petitioner are apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code and Section 138 of NI Act. Petitioner was cashier of Central Co-operative Bank, Madanpur Branch. Allegation is that petitioner and some others defalcated rupees twenty-seven lacs eighty thousand of the Co-operative Bank. An inquiry report submitted by Joint Registrar of the Co-operative Society dated 03.04.2019 reveals that entire money has already been deposited in the branch.

Patna High Court CR. MISC. No.79348 of 2019(2) dt.23-01-2020 2/2 However, dispute of payment of interest is there. Moreover, responsibility on three persons have been fixed including the Managing Director.

Considering the facts aforesaid and the statement of the petitioner on oath that he has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Aurangabad Town Police Station Case No. 320 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also both the bailors shall be resident of the territorial jurisdiction of the learned court below.
