Petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 506, 427 of the Indian Penal Code and later on Section 302 of the Indian Penal Code.
Submission is that initially a case under Section 307 of the Indian Penal Code was registered which was subsequently added with Section 302 of the Indian Penal Code after death of the victim. Petitioner is not one of the assailants of the injured/deceased. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two
Patna High Court CR. MISC. No.78916 of 2019(2) dt.04-12-2019 2/2 sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Lauriya Police Station Case No. 142 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
