The petitioner seeks bail in connection with Bidupur P.S. Case No.152 of 2019, registered for the offence under Section 379 of the Indian Penal Code.
It is submitted by learned counsel for the petitioner that co-accused Karamveer Kumar and Manish Kumar, having identical allegation as against the petitioner, have already been granted bail by a Bench of this Court vide orders dated 04.09.2019 and 19.09.2019 passed in Cr.Misc.No.59792 of 2019 and Cr.Misc.No.67995 of 2019 respectively. It is further contended that neither any incriminating article was recovered from the possession of the petitioner, nor the petitioner has been put on Test Identification Parade.
Patna High Court CR. MISC. No.74605 of 2019(2) dt.11-12-2019 2/2 Learned counsel for the State has opposed the prayer for bail, although he does not dispute the fact that two other similarly circumstanced accused have already been granted bail by a Bench of this Court.
Considering the facts and circumstances of the case, the petitioner, who is in custody since 24.05.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Bidupur P.S.
