The petitioner seeks bail in a case registered under Sections 363, 364 of the Indian Penal Code.

Allegation is that on 12.09.2019 the informant's son, namely, Chhotu Kumar had gone to work to quarter No.39, but he did not return back.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.09.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The victim has been recovered. His statement has been recorded under Section 164 of Cr.P.C. The

Patna High Court CR. MISC. No.73424 of 2019(2) dt.19-11-2019 2/2 victim has not named the petitioner. The Statement under Section 164 of Cr.P.C. is Annexure 2 to the present application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Ashutosh Kumar, A.C.J.M. 1st, Munger in connection with East Colony P.S. case No.97 of 2019.
