1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Dariyapur P.S. Case No. 36 of 2023 dated 24.01.2023 registered under Section 30(a), 41(i) (ii) of the Bihar Prohibition and Excise Act, 2016.

3. As per the first information report a total quantity of 336.96 liters of English wine has been recovered from a four wheeler bearing registration no. BR-38P-3705 and the Police apprehended two persons namely Anshu Raj and Rajesh Kumar.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case inasmuch as he has not committed any offence in the manner alleged. The name of the petitioner has transpired in this case only because he happens to be the registered owner of the vehicle in question.

No.84439 of 2025(2) dt.17-12-2025 2/2 The seized four wheeler was borrowed by the friend of the petitioner for some personal use and the petitioner was unaware about the fact that his vehicle was being used for transportation of illicit liquor. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the justification given by the petitioner regarding recovery of illicit foreign liquor and the fact that petitioner has no criminal antecedent, accordingly , I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge cum Exclusive Special Court Excise Act -I, Saran at Chapra in connection with Dariyapur P.S. Case No. 36 of 2023 subject to the condition as laid down under Section 482

(2) of the B.N.S.S. 2023.
