JUSTICE ARUN KUMAR ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sitamarhi P.S. Case No. 759 of 2015 instituted for the offences punishable under Sections272, 273, 147, 148, 149, 341, 323, 333, 353, 435, 427, 337 and 504 of the Indian Penal Code and section 47(A) of Excise Act. As per allegation, illicit country made liquor was recovered from the shop of Manoj Kumar @ Bhola Sah and on his instigation other accused persons tried to release him from police custody by pelting brick bats. Co-accused Sunil Kumar, Munna Kumar and Golu Kumar also set fire on official motor-cycle of the police.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner relating to assault and setting fire in the motor-cycle. He has clean antecedent.

Patna High Court Cr.Misc. No.32252 of 2018 (2) dt.23-05-2018 2/2 in the event of his arrest or surrender in the court below within four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sitamarhi P.S. Case No. 759 of 2015 to the satisfaction of learned ADJ II-cum-Special Judge, Excise Act, Sitamarhi subject to condition as laid down u/S 438(2) of the Cr.P.C..
