2. The petitioner has preferred this application for grant of regular bail in connection with Mahua P.S. Case No. 317 of 2008 dated 26.11.2008 registered for the offences punishable under Sections 304B, 498A, 201, 120B read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have killed the sister of the informant due to non-fulfillment of demand of dowry. It is further alleged that the accused persons with the help of others have burnt the body of the informant's sister at night.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.81113 of 2025(2) dt.01-12-2025 2/2 this case. The petitioner is the brother-in-law of the deceased and he has no concern with the alleged offence. The husband of the deceased is already in custody. There is general and omnibus allegation against the petitioner. The petitioner neither demanded any dowry nor tortured the deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 26.07.2025. The co-accused person has already been granted regular bail by this Court vide order dated 17.11.2025 passed in Cr. Misc. No. 77470 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Mahua P.S. Case No. 317 of 2008.
7. The application stands allowed.
