2. The petitioner apprehends his arrest in a case registered for offence under Sections 420, 467, 406/34 of the Indian Penal Code.

3. The allegation against this petitioner is that he alongwith other government officials misappropriated government subsidized funds allotted for distribution of Pumpsets, seeds and preparation of threshing floor.

4. Learned counsel for the petitioner submits that at the relevant time, petitioner was posted as "Vishay Vastu Visheshagya (Subject Matter Specialist)" on contract basis and

He further submits that from bare perusal of the F.I.R., it is apparent that so far as maintenance of record is concerned, petitioner had got no concern with the same, since records are maintained in the office of District Agricultural Officer or in the Block Agriculture Officer and the staff of the aforesaid two offices are responsible for properly maintaining the record. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, West Muzaffarpur in connection with Motipur P.S. Case No. 148 of 2012, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
