2. The petitioner has prayed for bail in connection with Parwalpur P.S. Case No. 109 of 2023 instituted for the offence under Sections 302, 380, 452, 120(B)/34 of the Indian Penal Code.
3. As per allegation in the FIR, it is a case of double murder. The informant alleged that the petitioner is indulged in hatching conspiracy to kill the informant's son Ansh Patel and her mother-in-law Mina Devi in connivance with others. It is also alleged that ornaments along with cash were also looted from her house.
4. Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence. He has falsely
Patna High Court CR. MISC. No.82770 of 2023(3) dt.09-02-2024 2/3 been implicated in this case on the basis of suspicion. The informant herself is not an eye witness to the alleged occurrence. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 2.7.2023.

Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner is named in the FIR who has specifically been alleged to commit murder of the mother-in-law and son of the informant. During course of investigation, the petitioner was arrested and confessed his guilt vide para 24 of the case diary stated therein that he committed murder of son & mother-in-law of the informant. It is also submitted that at the instance of confessional statement of this petitioner, as alleged stolen ornaments as well as cash of rupees were recovered from fodder house of the petitioner which is clearly shown in seizure list. Vide para 49 of the case diary, it appears that the seized ornaments were put on TIP for identification and the same were identified by the informant.
6. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer
Patna High Court CR. MISC. No.82770 of 2023(3) dt.09-02-2024 3/3 for bail stands rejected.
7. The trial Court is directed to expedite the trial and conclude the same as soon as possible.
