JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Deepnagar P.S. Case No. 246 of 2019 for the offence under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2016.
In the instant case total 25 litres of country made liquor was seized.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that nothing was recovered from the possession of the petitioner. He further submits that co-accused Vikash Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 03.12.2019 passed in Cr. Misc. No. 78723 of 2019.
Considering the aforesaid, the petitioner named
Patna High Court CR. MISC. No.76185 of 2019(3) dt.06-03-2020 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Nalanda at Bihar Sharif in connection with Deepnagar P.S. Case No. 246 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
