Petitioner/s

For the Petitioner/s :

Mr.Bimlesh Kumar Pandey For the Opposite Party/s :

Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-04-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with Govindganj P.S. Case No. 302 of 2024, registered for the offences punishable under Sections 80(2), 61(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per FIR, the marriage of the deceased was solemnized with the petitioner on 10.02.2022. After 15-20 days of her marriage, the accused persons, named in the FIR, started torturing her for demand of dowry. Sister of mother-in-law and sister-in-law of the deceased inflicted mental torture upon her. On 01.08.2024, when the sister of the informant came to her native place, she apprised to her family members about her torture. On 18.08.2024, at about 12:50 pm, the deceased had a talk with her father and she had requested her

Patna High Court CR. MISC. No.85725 of 2024(5) dt.09-04-2025 2/2 father to bring her back to her native place. On the next day, at about 9 AM, the informant received an information that she was strangulated to death. Her dead body was found hanging with the ceiling fan.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation is against mother-in-law, her sister and sister-in-law of the deceased and not against the petitioner, who is husband of the deceased. He has submitted further that as per postmortem report, no injury was found on the dead body, except ligature mark around the neck of the deceased.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that it has come in the statements of the witnesses that before her death, the deceased was slapped by her husband (the petitioner). The accused persons tortured her for non-fulfillment of demand of dowry and she died within two and a half years of her marriage.

6. In my view, the petitioner does not deserve the privilege of bail, which is hereby rejected.
