2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 307, 324, 326, 341, 323/34of the Indian Penal Code and Section 27 of the Arms Act.
3. Petitioner is said to have fired upon the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that earlier FIR has been lodged under Section 307 of the IPC but during course of treatment, the wife of informant succumbed to the injury, thereafter, I.O. has filed application for addition of Section 302 of the IPC. He further submits that petitioner has no criminal antecedent as stated in
Patna High Court CR. MISC. No.84992 of 2023(2) dt.15-01-2024 2/2 para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Noorsarai P.S. Case No. 30 of 2023.
