The petitioner is accused in connection with Sadar Saharsa P.S. Case No. 762 of 2019, registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is of recovery of one country made loaded pistol and five live cartridges from possession of the petitioner.

Learned counsel for the petitioner submits that while petitioner is accused in one another case, i.e., Sadar Saharsa P.S. Case No. 100 of 2019 but in that case, he is on bail and in the present case, he is in custody since 24.08.2019. Having regard to the facts and the circumstances of

No.74145 of 2019(3) dt.17-03-2020 2/2 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sadar Saharsa P.S. Case No. 762 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
