====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Sakatpur P.S. Case No.65 of 2019 registered under Section 363 of the Indian Penal Code.

The accusation is that Kusheshwar Mukhiya alias Nirhau, the husband of the informant Sona Devi, who used to do the work of mason, came at about 01.00 P.M. on 09.08.2019 at his house to take the lunch and at the time of leaving the house, he informed the informant that he has to go to take the due money at Lagma but he did not return till late night of 12.08.2019. While the informant searched her husband but his no trace was found.

No.74737 of 2019(3) dt.19-03-2020 2/2 Learned counsel appearing on behalf of the petitioners submits that on the basis of the fardbeyan of the informant, initially, the present case was lodged against unknown but, in course of investigation, the informant gave an application, as detailed in paragraph-75 of the case diary, that the money of her husband was due against the petitioner no.1, resident of village-Lagma. Except that, nothing has been collected by the Investigating Officer, in course of investigation and, on investigation, the police has already submitted the charge-sheet against the petitioners. The petitioners are in custody since 18.08.2019.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Darbhanga, in connection with Shakatpur P.S. Case No.65 of 2019.
