2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

3. According to F.I.R., this petitioner, in conspiracy with other accused person, namely, Rajendra Kumar Chaudhary is alleged to have assaulted the son of informant as a result of which he died during course of treatment.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. From bare perusal of the F.I.R., it is apparent that wife of Satyendra Chaudhary did not see anyone at the alleged place of occurrence other than co-accused Rajendra Kumar Chaudhary and it was co-accused Rajendra Chaudhary who was seen fleeing away

Patna High Court CR. MISC. No.84144 of 2024(3) dt.27-01-2025 2/2 with blood-stained gamcha. He further submits that brother of the deceased has clearly stated on 22.5.24 in the Emergency Ward of Patna Medical College Hospital, Patna that due to previous enmity, co-accused Rajendra Kumar Chaudhary killed his brother and he has not whispered anything about this petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Dulhin Bazar P. S. Case No. 125 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
