2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Dehri (T) P.S. Case no. 839 of 2023 instituted for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2018.
3. The case of the prosecution is that two persons started fleeing after seeing the police. They could not be
Patna High Court CR. MISC. No.86242 of 2024(2) dt.20-12-2024 2/3 apprehended. After this, the bush near the canal was searched and from that bush, 75 liters of countrymade liquor was recovered. Villagers disclosed the name of these petitioners. Accordingly, the FIR.
4. Learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been implicated in connection with the present case. Nothing has been recovered from the conscious possession of the petitioners. Further submission is that the petitioners are having no criminal antecedent.
5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Dehri (T) P.S. Case no. 839 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 1, Rohtas at Sasaram, subject to the conditions as laid
