In this case, the petitioner is apprehending his arrest in connection with Economic Offences Unit P.S. Case No. 20 of 2012 giving rise to Special Case No. 35 of 2012 registered for offences under sections 420, 465, 467, 468, 471, 120(B) of the Indian Penal Code and Section 8, 12, 13(1)(d) read with Section 13 (2) of the Prevention of Corruption Act. As per First Information Report, the accused persons dishonestly and knowingly leased the land of Ganga Son Flood Protection Area, Patna in favor of the private persons
Patna High Court Cr.Misc. No.26976 of 2018(3) dt.07-05-2018 2/3 and got forged documents like Jamabandi and rent receipt created in their favor in collusion of the officials of the Irrigation Department, Revenue Department, Patna Municipal Corporation encroaching upon the land and apartment is under construction.
The petitioner has purchased the land and transferred the same after 3-4 years, submitted no concern with the land. It also appears that large number of persons have approached this Court and they have been granted bail. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Md. Noor Alam Khan, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Economic Offences Unit Police Station Case No. 20 of 2012 corresponding to Special Case No. 35 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the Economic Offence Unit will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the
