The petitioner seeks direction to the District Programme Officer (Establishment), Muzaffarpur to pass order for grant of 2nd A.C.P. and other consequential benefits under A.C.P./M.A.C.P. schemes.

Learned counsel for the petitioner submits that the petitioner retired from service on 31.08.2010. The petitioner was appointed as a matric trained teacher in Yamuna Middle School, Nayatola Anchal Town, District Muzaffarpur on 22.07.1971. The first time bound promotion was granted to the petitioner on 22.07.1981 but thereafter no time bound promotion was granted

Patna High Court CWJC No.22936 of 2019(3) dt.04-02-2020 2/2 to the petitioner till the date of his retirement. It is further submitted that a coordinate Bench of this Court by order dated 23.04.2018, passed in CWJC No.10564 of 2016, directed the authority to pass order in accordance with law as to whether the petitioner of that case is entitled to get time bound promotion under the prevalent scheme and if the petitioner is entitled, pass order in accordance with law and pay consequential benefits within three months from the date of receipt of this order. Having considered the facts, I dispose of this writ petition with a direction to the respondent, the District Programme Officer (Establishment), Muzaffarpur to dispose of the representation of the petitioner filed on 07.09.2014, within three months from the date of receipt of this order and if it is found that the petitioner is entitled to get time bound promotion under the prevalent scheme during the service period of the petitioner, the consequential benefits must be given to the petitioner within three months thereafter.

With the aforesaid directions, the writ petition is disposed of.
