The petitioner seeks bail in connection with Amba P.S. Case No. 69 of 2019, registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving secret information about moving of four persons on stolen motorcycle, the informant, along with other police personnel, started checking the vehicle. In that course four persons were apprehended with the motorcycle, who disclosed their names Deepak Kumar, Vikas Kumar, Ranjit Kumar and Amit Kumar. On query, they disclosed that motorcycle was purchased from the petitioner. Submission is that petitioner was not apprehended on spot rather his name has come in the confessional statement of co-accused, who disclosed that the seized motorcycle was sold

Patna High Court CR. MISC. No.78173 of 2019(2) dt.09-12-2019 2/2 by the petitioner to them. In fact, petitioner was made accused in Amba P.S. Case No. 57 of 2019 and the petitioner was in custody since 28.08.2019 in that case, thereafter, he has been remanded in the present case on 31.08.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Amba P.S. Case No. 69 of 2019 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, subject to the condition that out of the two bailors, one must either be the parent or close relative of the petitioner.
