2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(c) and 21(b) of the NDPS Act.

3. The case of the prosecution is that from the possession of this petitioner, altogether 12.60 grams of smack like material was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. It is also submitted that the amount of the seized

Similarly situated othe4r co-accused has been granted bail by the Co-ordinate Bench of this Court vide order dated 23.01.2025 in Cr. Misc. No. 87878 of 2024. It is further submitted that the petitioner is languishing in judicial custody since 25.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submits that the petitioner is having criminal antecedent of five cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Special (NDPS) Case no. 98 of 2024 arising out of Jankinagar P.S. Case No. 235 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS Act), Purnea.
