The petitioner seeks regular bail in connection with Rail Kiul (Barahiya) PS case no. 150 of 2019 instituted for the offence punishable under Sections 379, 411 of Indian Penal Code.

The allegation is regarding recovery of a sum of Rs. 8,810/- and a mobile without sim from the possession of the petitioner.

The learned counsel for the petitioner has submitted that there is no material on record to suggest that the said articles, recovered from the petitioner including cash, are stolen one and the fact is that the same belongs to the petitioner

Patna High Court CR. MISC. No.73997 of 2019(2) dt.04-12-2019 2/2 herein. It is further submitted that the petitioner has been falsely implicated in the present case, is having a clean antecedent and he is languishing in custody since 19.08.2019. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway J.M. Kiul (Lakhisarai) in connection with Rail Kiul (Barahiya) PS case no. 150 of 2019.
