Petitioners apprehend their arrest in Purnahiya P.S. case no. 10 of 2018 instituted for the offence under Sections 323,341, 447, 326A and 379/34 of the Indian Penal Code. In the Fardbeyan the informant, namely, Manju Devi has alleged that she got information that these petitioners along with co accused Ravi Kumar Jha has caused serious injury to her daughter by throwing acid. The informant reached her house on getting the information and found her seriously injured. He took her to Sadar Hospital, Sitamarhi for treatment. Case diary has been received in this case.
Learned APP has stated that statement of the victim girl
Patna High Court Cr.Misc. No.28505 of 2018(3) dt.28-06-2018 2/2 has been recorded under Section 164 Cr.P.C. which is available in paragraph no. 128 of the case diary, wherein, the victim girl has taken the name of these petitioners along with other accused persons in causing injuries on her face and upper parts of the body and also causing injuries on her right thumb. The injury report of the victim girl is mentioned in paragraph nos. 100 and 136 of the case diary. The primary injury report issued from the Sadar Hospital, Sitamarhi is available in para 100 of the case diary. The injury report of S.K.M.C.H., Muzaffarpur is available in para 136 of the case diary wherein the doctor has found burn injury on the nose, throat, forehead as well as on the chest of the victim caused by chemical burn.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. Prayer for anticipatory bail of the petitioners stand rejected. Petitioners may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
