JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Excise Case No. 214 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and (Amendment) Excise Act, 2018.

Recovery of more than 93 liter of illicit liquor from the place of occurrence. Petitioner is named in the F.I.R. Submission of learned counsel for the petitioner is that F.I.R. itself shows that recovery is from the vacant place. He is in custody for about three months. Charge sheet has already been submitted, there is no chance of tempering with the evidence.

Having heard both sides, in view of the facts and

No.75012 of 2019(2) dt.11-12-2019 2/2 circumstances, as state above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge Excise, Rohtas at Sasaram in connection with Excise Case No. 214 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
