====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 16-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Govindganj P.S. Case No.529 of 2023, registered for the offences punishable under Sections 353(A), 341, 323, 307, 504, 342, 34 of the Indian Penal Code.

3. As per the prosecution case, when the Police team chased two accused persons who have demanded rangdari from the driver of Sudha Dairy then the petitioner alongwith other coaccused persons assembled there and tore the uniform of two constables and the petitioner was apprehended on the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

He further submits that petitioner is the villager of the said village and nothing incriminating has been recovered from the possession of petitioner. He also submits that there is no specific allegation against the petitioner and he has no criminal antecedent. Petitioner is in custody since 16.09.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Govindganj P.S. Case No.529 of 2023.
