JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-05-2018 The petitioner is apprehending his arrest in connection with Arwal P.S. Case No. 41 of 2018 registered for offences punishable under Sections 379 and 414/34 of the Indian Penal Code.

Allegation as per FIR is of recovery of stolen motorcycle from the possession of the co-accused Rahul, who has disclosed that he has sold the other motorcycle to the petitioner. It has been submitted on behalf of the petitioner that except confession, there is nothing against the petitioner and he has got no criminal antecedent.

Heard learned A.P.P. also.

In view of the nature of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner and it is,

Patna High Court Cr.Misc. No.28062 of 2018 (2) dt.15-05-2018 2/2 accordingly, rejected.

However, considering the facts and circumstances as detailed in the present application, let the petitioner surrender in the court below and the court below shall consider the case of the petitioner on its own merit and may grant regular bail without being prejudiced by this order on the same day.
