The petitioner seeks bail in connection with Chandi P.S. Case No.205 of 2019 registered under Section 302 read with 34 of the Indian Penal Code.

Considering that on completion of investigation the police submitted the final report holding the case to be a mistake of fact, but the learned Magistrate took cognizance of the offence differing with the police report and the co-accused Sukhdeo Prasad having identical allegation to that of the petitioner has already been granted bail by a reasoned and speaking order vide order dated 06.11.2019 passed in Cr.
