JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks bail in connection with Saharsa Rail P.S. Case No. 25 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code.

As per FIR 10-12 miscreants entered inside the train and looted several articles, including cash and motorcycle. It appears that there is recovery of looted SIM from the possession of the petitioner.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused, recovery of SIM there is nothing against him and he is in custody for five months, having no criminal antecedent.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.74568 of 2019(2) dt.13-01-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Khagaria, in connection with Saharsa Rail P.S. Case No. 25 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear in Railway Police Station, Saharsa in first week of each month for a period of six months, so that police may watch his conduct, otherwise his bail bonds shall be cancelled.

Let a copy of this order be communicated to the Railway Superintendent of Police, Katihar for needful. (Vinod Kumar Sinha, J) spal/- U T
