JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner rather it is recovered from tempo. He further submits that the petitioner is driver of the said tempo and has no criminal antecedent and is in jail custody since 24.10.2019.

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of Rs 5,000/- in the court below/ Nazarat. Let the above named petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the

Patna High Court CR. MISC. No.75829 of 2019(2) dt.27-11-2019 2/2 satisfaction of the Addl. Sessions Judge IV-cum- Special Judge, Excise Bhojpur at Arrah in Ara Town P.S. Case no. 522/2019. Such deposit of Rs 5,000/- shall abide by the outcome of the criminal case.
