1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 109(1) and 3(5) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that while Nitesh was coming from a fare on 21.04.2025 at 9.30 P.M., when he was intercepted by Krishna and Algu Yadav and accused stabbed him causing injury on stomach and threw him on bank of a canal.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case during

It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant specifically alleges that Krishna and Surendra intercepted his son and stabbed him causing injury on stomach, but then during the course of investigation, when the statement of the victim was recorded, he stated that he was intercepted by the accused persons including the petitioner and Sameer Khan stabbed him causing injury on stomach. It is next submitted that even presuming what has been alleged is true without admitting, then petitioner is not alleged to have assaulted the injured by knife causing injury on stomach. It is reiterated and submitted that in the FIR specific allegation of assaulting by knife is against Krishna and Surendra and petitioner is not named in the FIR, as such, it might be a possibility that during the course of investigation for ulterior reason other accused persons came to be instituted.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail

Patna High Court CR. MISC. No.80522 of 2025(2) dt.10-12-2025 3/3 on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Malahi P. S. Case No.135 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
