JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier prayer for bail of the petitioner was rejected by this Court by order dated 7.9.2017 passed in Cr.Misc.No. 39281 of 2017 and there is allegation of recovery of country-made pistol and cartridges from the petitioner and petitioner is accused in seven other cases.
Submission of learned counsel for the petitioner is that while rejecting prayer for bail it was observed that trial be concluded within a period of seven months and till date charge has not been framed and petitioner is in custody since 10.5.2017.
Heard learned APP also.
In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.84949 of 2019(2) dt.26-02-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P. S. Case No. 106 of 2017 on the condition that before releasing the petitioner the court below shall verify the address of the petitioner as well as the bailors and further condition that he has to appear before the trial court as and when required, otherwise prosecution is at liberty to move for cancellation of bail bonds of the petitioner.
