JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks regular bail in connection with Bahera P. S. Case No. 277 of 2016, registered for the offences punishable under Sections 8/20(b)(A)/20(b) (ii)(B)/25 of the Narcotic Drugs and Psychotropic Substances Act. As per F.I.R. there is recovery of 04 Kg of Ganja from the house of the petitioner.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. As a matter of fact, husband of the petitioner was arrested in connection with the sale of ganja. Earlier he is in custody and as such, she has no knowledge about keeping of ganja in her house. She is in custody for more than one month. She has no criminal antecedent. She is ready to abide by any condition imposed upon her.

Having heard both sides, in view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner. However, she is at liberty to renew her prayer for regular bail, once charge is framed. With the above observations, this application is dismissed.
