JUSTICE HARISH KUMAR ORAL ORDER 20-11-2025 Since both the cases are arising out of the same P.S. case, hence with consent of the parties, they are being heard together and disposed off by a common order.
2. The petitioners apprehend their arrest in connection with Nanpur P.S. Case No.285 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2),
Patna High Court CR. MISC. No.73400 of 2025(3) dt.20-11-2025 2/3 127(2), 115(2), 118(1), 109, 74, 303(2), 352 and 351(2) of the BNS, 2023.
3. While the informant was sitting at his door with his younger brother, in the meanwhile, fourteen named and ten unknown accused persons, including the petitioners variously armed came there and started abusing and asked them as to why they had filed a complaint case. When the informant replied and protested, the accused persons brutally assaulted. It is specifically alleged against the petitioners that they misbehaved with the informant's daughter-in-law and grand-daughter. There is further allegation of snatching of valuables as well as active participation in the crime.
4. Learned Advocate for the petitioners contended that besides the omnibus nature of allegation, admittedly the occurrence took place on account of previous enmity as is evident from the FIR. It is the further contended that the occurrence took place on 05.07.2025, but the present FIR came to be instituted on 07.07.2025. The petitioners are co-villagers and closely associated with other co-accused persons; hence, their name has also been implicated in this case. Moreover, the petitioners bear fair antecedent and they undertake that they will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application.
6. Having considered the submissions advanced by the learned Advocate for the respective parties and considering the omnibus nature of allegation, coupled with the fact that no injury has been attributed against the petitioners, besides their fair antecedent, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri Sitamarhi in connection with Nanpur P.S. Case No.285 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners.
