07-05-2018 Heard Sri Brajesh Sahay, learned counsel assisted by Sri Umesh Prasad, learned counsel for the petitioner and Sri Ram Naresh Ray, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 17-10-2017 in Jhajha P.S. Case No. 137 of 2017 registered for offence under Sections 399, 402 of the Indian Penal Code and Sections 25 (1-b)A/26/35 of the Arms Act, 1959, has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner has been made accused on the basis of confessional statement of one of the co-accused. He submits that save and except so-called confessional statement, there is no other material to connect the petitioner in the present case. He further

Patna High Court Cr.Misc. No.27716 of 2018(2) dt.07-05-2018 2/2 submits that some of the accused persons have been granted bail.

Considering the nature of accusation as well as fact that petitioner's name has come only on confessional statement of the co-accused, there is no reason to further detain the petitioner.

Let the petitioner namely Bijay Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No. 137 of 2017.
