The petitioner seeks bail in connection with Chautham P.S. Case No. 100 of 2025 instituted for the offence under Sections 319(2), 318(4), 338, 336(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that the informant claiming ownership of ancestral Khatiyani land at Mouza Borney Patti, alleged that the accused persons fraudulently created fresh Jamabandi in their names by tampering with revenue records and illegally harvested crops for years. Despite cancellation of Jamabandi by this Court and direction for lodging of FIR against the accused persons, they have

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.09.2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is land dispute between the parties and the matter is civil dispute between the parties. There is no specific allegation against the petitioner. It is mainly submitted that similarly situated co-accused has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 13.10.2025, passed in Cr. Misc. No. 58917 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
