2. The petitioners seek bail in connection with Bandeya P.S. Case No. 48 of 2023 registered for the offence under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, the deceased has been assaulted by the accused persons including the petitioners and the deceased died after 25 days of the occurrence when he was undergoing treatment.

4. Learned counsel for the petitioners submit that the petitioners are innocent and have falsely been implicated in this case and there is general and omnibus allegation against all the

Patna High Court CR. MISC. No.1548 of 2024(2) dt.18-01-2024 2/2 accused persons. He further submits that petitioner no. 1 is an old lady and no offence under Section 302 is made out.

5. It is also submitted by the learned counsel for the petitioners that the petitioners are in jail since 9.9.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioners for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioners, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Daudnagar, Aurangabad in connection with Bandeya P.S. Case No. 48 of 2023.
